terms and conditions1. REGISTRATION1.1 To register as a customer of Mylunchonline, follow the registration prompts on our website. Once you have registered, you will have access to the site via your username and password. 1.2 You must ensure that your personal details are secure and not disclosed to any third party, as they are personal to you and for your use only. You must not permit anyone to use your personal details as you will be responsible in the event of any third party using your details to purchase products from the Mylunchonline website. If any third party obtains your username and/or password, you must email us immediately via the Contact Us page or change your password using the prompts menu provided on the website. 1.3 Once you have registered, it is our policy to protect your privacy and maintain the security of any personal information received from you. We adhere to the requirements of the Data Protection Legislation in the UK and will only contact you with your consent to update you on any new products or services we offer. 1.4 Registration is also subject to us being able to deliver to your area and chosen delivery point. If we are unable to deliver to your area, you will not be able to complete the registration process. 2. PURCHASING PRODUCTS2.1 You may purchase products online by browsing our website, provided the registration process has been completed. To complete your registration for the online delivery service, payment is required. Most leading credit and debit cards including VISA and Mastercard will be accepted. Payment is made through Paypal. 2.2 On completion of your order, Mylunchonline will endeavour to complete and deliver your order within the agreed time period. 2.3 There is a cut-off time for orders from the website and orders cannot be accepted after any given cut-off time. Any cancellations or amendments to an order must be made by 4pm the previous working day before delivery by emailing us. We regret we cannot accept cancellations or amendments on the date of delivery. If you miss the cut-off time of 4pm the previous day, your order will simply be delivered on the next working day. To avoid missing the cut-off time, you might want to consider placing a recurring order, subject to the terms for recurring orders below. 2.4 The website provides a facility to order products on a regular, e.g. weekly, basis and if any such recurring order is made your account will be debited as soon as you click on recur order. 2.5 Some products may be specially ordered to your requirements and any amendment or cancellation to these orders must be made no later than midday of the previous working day. Daily or weekly specials will be detailed on the website. 2.6 Orders made represent an offer by you to purchase the products, subject to these terms and conditions. Acceptance of any order is at our sole discretion. An order is deemed to have been accepted by us when you receive an email confirmation to this effect after placement of your order. Once we have accepted your order, there may, on occasions, be reasons beyond our control which may make it impossible for us to complete your order. In such cases we will need to contact you and ask you to amend or revise your order. If you have difficulties in placing your order online, ring our helpline on 01789 748185. 3. PAYMENT FOR PRODUCTS3.1 Prices will be displayed on the price list shown on our website. Prices charged will be those current at the date of your order and we reserve the right to make any changes in prices without notice. Payment must be made before any order can be despatched. 3.2 No charge is made for deposits by bank transfer and no interest is paid on any deposits held by Mylunchonline to customers in any circumstances. 3.3 Please note that Mylunchonline reserves the right to accept or refuse any application for registration for any accounts and to terminate any accounts at any time and not give any reason for such a decision. 4. SECURITY4.1 Mylunchonline uses secure technology (including Paypal) to protect its customers. 5. DELIVERY5.1 Our products will be delivered at an agreed collection point. We can only accept orders if the delivery point has been mutually agreed at the time of registration. 5.2 All deliveries must be checked and signed for by an approved representative of the customer on delivery. The signature of such representative will be deemed to constitute acceptance of the delivery of the complete order. 5.3 If any part of the order is found to be missing, or is rejected by you, please inform us immediately by calling our Customer Service line on 01789 748185. 6. TERMS OF SUPPLY6.1 Any products supplied are strictly for your use and under no circumstances should any of our products be re-sold to a third party. If any food products are not consumed on the date of purchase, ie later than the use-by date, we cannot be held responsible for any outcome. In any event you should ensure that any food products requiring refrigeration be stored at the correct temperature. 6.2 If you find any of our products or food items unsatisfactory, please contact us immediately. You must, if requested, arrange for any such products to be collected at the agreed delivery point at the time of the next due delivery. It is at the discretion of Mylunchonline to promptly refund the full cost of any unsatisfactory products. 6.3 Subject to clause 7 below, we will not accept any further claims for loss or damage from or in connection with the supply of faulty products or food items whether direct, indirect, consequential or otherwise, howsoever arising. 7. LIABILITY7.1 We do not accept liability in contract or tort (without limitation) or otherwise in respect of any products delivered or otherwise in connection with an order for any loss, injury or damage attributable directly or indirectly to any customer. We will, at our sole discretion, deliver replacement products should loss or damage have occurred. 7.2 We will not accept any liability whether or not caused by our negligence or otherwise for any loss of profit or goodwill or reputation suffered or incurred by you or any third party nor for any indirect or consequential loss as a result of any tortuous act or breach of contract or otherwise. 7.3 We will not accept any liability for any loss, injury or damage suffered directly or indirectly by any other use or inability to use our online delivery service or our website. This includes, but not exclusively, any inaccessibility or malfunctioning of the website due to no fault of our own. 7.4 These terms and conditions will not limit or exclude the liability for death or personal injury to customers caused by negligence on our part and nothing in these terms and conditions will in any event affect your statutory rights. 8. TERMINATION8.1 You can withdraw your registration by emailing our helpdesk at any time. 8.2 We reserve the right to terminate your access to our website with or without notifying you in advance. 9. MYLUNCHONLINE WEBSITE9.1 All rights in the design, computer codes, graphics, text and other content are the absolute property of Mylunchonline or its developers. You may, however, print or download portions of the site for your own personal use only. Any other use is prohibited unless you receive our prior written permission. 10. VARIATION OF THESE TERMS AND CONDITIONS10.1 We reserve the right to amend the terms and conditions from time to time and at our sole discretion without notice. Your continued use of our online delivery service after such amendment will constitute your acceptance of any amendments. You should therefore ensure that you keep up to date with the terms and conditions. If in our opinion any material amendment or revision is made in the terms and conditions, notice of such amendments will be emailed to all registered users of our online delivery service to their registered email address. If there is a change in your registered email address, or your details, you must notify us as soon as possible. 10.2 If you do not wish to accept any amendment or revision in these terms and conditions, then you should immediately withdraw your registration from our online delivery service by sending an email terminating your arrangement with us. 11. FORCE MAJEURE11.1 Although we aim to provide uninterrupted service and access to our site, this cannot be guaranteed and we can therefore accept no responsibility or liability for any interruption or delay for any reason beyond our control. 11.2 In the event that we cannot fulfil obligations to you under this agreement for whatever reason, then we will notify you as soon as we are able and we will be relieved of any obligations to you under these terms and conditions to the extent that such performance has been interrupted by any such event. 12.
